Mediation Services
This form of dispute resolution has been defined as a voluntary, non-binding and without prejudice process in which a trained third party (the Mediator) intervenes in a dispute and attempts to bring the parties together into a settlement agreement.
Mediation has much to commend it: over 85% of cases which go to mediation settle then or shortly afterwards.
Our experience is that the cases which fail to settle are either those where mediation is attempted too early (before the issues have been fully brought to the surface) or where, for whatever reason, one party enters into the process in a halfhearted or bad-faith manner.
As well as conducting mediation in many of our own cases, the firm also conducts a mediation service for parties in dispute. The service provides one of our partners, Hugh Davey, a fully trained mediator and with extensive experience of the subject. We can arrange for a neutral venue, anywhere in the country.
